Background
On 11 September 2025, the development application was lodged with the Council.
On 16 October 2025, the Council refused the development application for a number of reasons.
On 28 November 2025, the Applicant commenced proceedings in Class 1 of the Land and Environment Court’s jurisdiction appealing against the Council’s refusal of the development application.
The proceedings are listed for hearing on 15 May 2026 commencing at 10:00am at the Land and Environment Court in Sydney (225 Macquarie Street, Sydney).

The development application and documents accompanying the application are available on the QPRC website at https://www.qprc.nsw.gov.au/notification during the public exhibition period.
Making a submission:
During the public exhibition period any person can make a submission to Council in relation to any aspect of the development application. Submissions must specify the grounds for objection, if any. All submissions are to be sent directly to Council’s Solicitors, Marsdens Law Group, and must reference Development Application No. DA.2025.0420.
Submissions must be received by 5 May 2026, and may be lodged by:

Please note that submissions will be provided to the Court and other parties and may form part of the public record.
If you make a submission, you must include the attached ‘Declaration of Political Donations and Gifts for Submitters’ to disclose donations or gifts made to Councillors or Council staff. This is required under s10.4 of the Act and significant penalties apply for non-disclosure.
If you declare ‘yes’ on the attached form, you must also complete and return with your submission the form entitled ‘Political Donations and Gifts Disclosure Statement to Council’, available on Council’s website – www.qprc.nsw.gov.au. A hard copy of this form can be obtained from Council’s Customer Service team at the Queanbeyan, Bungendore, or Braidwood offices.
Invitation to Give Evidence at the Hearing:
If you have concerns in relation to the development application, you may also wish to make an oral submission at the hearing of these proceedings.
If you wish to give evidence, you will be required to attend the hearing on 15 May 2026 at the Land and Environment Court (or by AVL link if approved by the Court).
The hearing will commence at 10:00am at the Land and Environment Court (225 Macquarie Street, Sydney), at which time the Commissioner of the Land and Environment Court who is hearing the proceedings will take evidence from individuals who wish to make a submission in relation to the development application.
You will not be required to attend the remainder of the hearing; however, you are welcome to do so if you wish.
Submissions are ordinarily made in person; however, a request to the Court for alternative arrangements may be made if you are unable to attend the Land and Environment Court in person to provide oral evidence.
We confirm that a copy of your submission to the Council in relation to the development application will be provided to the Court regardless of whether you register to provide oral evidence at the hearing.
